Terms of Service (Customer Agreement)
These Terms of Service ("Terms") set out the agreement between you ("you", "your", or the "Client") and Anchor Derivatives () ("we", "us", "our", or the "Company") governing your access to and use of our website, trading platforms, and related services (together, the "Services"). Please read these Terms carefully. They are a binding legal agreement.
1. Acceptance of these Terms
By registering for an account, accessing the website, or using any of the Services, you confirm that you have read, understood, and agree to be bound by these Terms, together with any documents they refer to (including our Privacy Policy and Risk Warning). If you do not agree, you must not use the Services. If you are entering into these Terms on behalf of a company or other legal entity, you confirm that you are authorised to bind that entity.
2. Eligibility and age
To use the Services you must be at least 18 years old (or the age of legal majority in your jurisdiction, if higher) and have the legal capacity to enter into a binding contract. You must not use the Services if you are resident in, or accessing them from, a country where doing so would breach local law or any restriction applicable to us. We may refuse, restrict, or close access where we believe these conditions are not met.
3. Account registration and identity verification (KYC)
To open and operate a live account you must complete our registration process and provide the information and documents we request to verify your identity, address, and source of funds. This process forms part of our "Know Your Customer" (KYC) and anti-money-laundering obligations. We may decline to open an account, or suspend an existing account, until verification is complete to our satisfaction. You are responsible for keeping your login credentials confidential and for all activity carried out under your account. Notify us promptly if you suspect any unauthorised use.
4. Your responsibilities and accurate information
You agree to provide information that is true, current, and complete, and to keep it up to date. You are responsible for the security of the device and connection you use to access the Services, and for understanding the products you trade. You confirm that any funds you deposit are your own, are from a lawful source, and are not the proceeds of any criminal activity. Providing false, misleading, or incomplete information may result in suspension or termination of your account and may be reported to the relevant authorities.
5. Deposits, withdrawals, and fees
You may fund your account using the payment methods we make available from time to time. Withdrawals are paid, where possible, to the same method and account from which funds were deposited, in line with our anti-money-laundering procedures. We may apply spreads, commissions, financing or overnight charges, payment-processing costs, inactivity fees, and other charges. The fees, minimum amounts, and processing times that apply to your account are set out in our published schedule.
We may apply currency conversion where a deposit, withdrawal, or trade is in a currency other than your account base currency, and exchange-rate movements may affect the amount you receive. We do not accept third-party payments; funds must come from an account held in your own name.
6. Leverage, CFDs, and the high-risk nature of the products
Many of the products available through the Services — including contracts for difference (CFDs) and other leveraged instruments across forex, crypto, stocks, options, and related markets — are complex and carry a high risk of losing money rapidly because of leverage. Leverage can amplify your gains, and it amplifies your losses just as quickly; you can lose more than your initial deposit unless negative-balance protection applies to your account. These products are not suitable for everyone. Before trading, make sure you understand how each product works and whether you can afford to take the risk of loss. Nothing in the Services is, or should be taken as, personalised investment, financial, tax, or legal advice; we provide execution and general information only. 7. Prohibited use
You must not use the Services for any unlawful or improper purpose. In particular, you must not:
- engage in fraud, money laundering, terrorist financing, or any attempt to disguise the source of funds;
- engage in market abuse, including manipulation, insider dealing, or trading on misappropriated or non-public information;
- exploit errors, latency, price feed faults, or platform malfunctions, or use abusive, predatory, or arbitrage strategies that we reasonably consider improper;
- use bots, scrapers, or unauthorised automated systems, or interfere with or attempt to gain unauthorised access to our systems or other users' accounts;
- provide false information, open multiple accounts to abuse promotions, or act on behalf of an undisclosed third party; or
- breach any applicable law, regulation, or sanctions regime.
We may investigate suspected breaches, reverse or cancel affected trades, withhold funds pending investigation, and report activity to regulators or law-enforcement authorities where required.
8. Demo accounts
We may offer demo or practice accounts that simulate trading with virtual funds. Demo accounts are provided for learning and familiarisation only. Market conditions, pricing, execution speed, and slippage in a demo environment will not reflect live trading, and results achieved on a demo account are not indicative of results on a live account. No real money is involved and no profits are payable.
9. Intellectual property
All content, software, trademarks, logos, designs, text, data, and other materials made available through the Services are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Services for your own lawful trading activity. You must not copy, modify, distribute, reverse-engineer, resell, or create derivative works from any part of the Services without our prior written consent.
10. Service availability and no warranty of uninterrupted service
We aim to keep the Services available and functioning, but we do not warrant that they will be uninterrupted, error-free, secure, or always available. Access may be affected by maintenance, upgrades, market conditions, third-party providers, internet or hardware failures, and events beyond our reasonable control. The Services and all content are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We may suspend, withdraw, or restrict all or part of the Services at any time.
11. Limitation of liability
To the fullest extent permitted by applicable law, we are not liable for any trading losses you incur, or for any indirect, incidental, special, consequential, or punitive losses, including loss of profit, opportunity, data, or goodwill, arising from or in connection with your use of the Services. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, such as liability for fraud or for death or personal injury caused by negligence.
12. Suspension and termination
You may close your account at any time in accordance with our procedures, subject to settling any open positions and outstanding amounts. We may suspend, restrict, or terminate your access to the Services, with or without notice, where we reasonably believe you have breached these Terms or applicable law, where required by a regulator or court, where there is suspected fraud or security risk, or where continuing to provide the Services would expose us to legal or regulatory risk. On termination, your right to use the Services ends, but provisions that by their nature should survive (including those on prohibited use, intellectual property, liability, and governing law) will continue to apply. We will return any remaining verified balance to you, less any amounts properly owed, subject to our anti-money-laundering obligations.
13. Amendments to these Terms
We may update or amend these Terms from time to time to reflect changes in our Services, business, or legal and regulatory requirements. When we make material changes, we will take reasonable steps to notify you, for example by posting the updated Terms on our website or contacting you. The "Effective date" below shows when the current version took effect. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
14. Governing law and dispute resolution
